These Terms of Service ("Terms") govern your use of the StroomR website at stroomr.nl and participation in the StroomR energy management pilot program. By accessing our website or applying for the pilot program, you agree to these Terms.

1. About StroomR

StroomR B.V. is a company registered in the Netherlands that provides energy management services for homeowners and greenhouse operators. We operate a pilot program to test and demonstrate our energy optimization technology.

2. Pilot Program

Eligibility

The pilot program is available to:

• Homeowners in the Netherlands with solar panels
• Greenhouse operators in the Netherlands

Participation is subject to availability and our acceptance of your application. We reserve the right to accept or decline applications at our discretion.

Cost

The pilot program is provided free of charge. There are no upfront costs, subscription fees, or hidden charges during the pilot period. You retain 100% of the energy savings generated by our system.

Duration

The pilot program runs for a defined period as communicated during onboarding. We may extend, modify, or conclude the pilot program at any time with reasonable notice to participants.

Your Obligations

As a pilot participant, you agree to:

• Provide accurate information in your application
• Grant access to your smart meter data (P1 port) and compatible devices
• Maintain a working internet connection for the energy management system
• Not tamper with or reverse-engineer the StroomR system
• Report any issues or malfunctions promptly

Device Control

Our energy management system may automatically control connected devices (heat pump, EV charger, battery, boiler) to optimize energy usage. You can override or disable automatic control at any time through the StroomR dashboard. StroomR is not liable for any discomfort or inconvenience resulting from automatic device control within normal operating parameters.

3. Website Use

Acceptable Use

You agree not to:

• Use the website for any unlawful purpose
• Attempt to gain unauthorized access to our systems or data
• Transmit malware, viruses, or other harmful code
• Scrape, crawl, or collect data from our website without permission
• Interfere with the proper functioning of the website

Account Information

You are responsible for maintaining the accuracy of the information you provide. If your contact details change, please notify us so we can keep you informed about the pilot program.

4. Intellectual Property

All content on the StroomR website — including text, graphics, logos, images, software, and the energy management algorithms — is the property of StroomR B.V. or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works of our content without prior written consent.

5. Energy Savings Disclaimer

Energy savings estimates shown on our website (including the calculator) are indicative and based on typical scenarios. Actual savings depend on many factors, including:

• Your energy consumption pattern
• Solar panel system size and orientation
• Connected devices and their usage
• Energy contract type and rates
• Weather conditions
• Grid regulations and feed-in tariffs

We do not guarantee specific savings amounts. Past performance during the pilot is not a guarantee of future results.

6. Limitation of Liability

To the maximum extent permitted by Dutch law:

• StroomR provides the pilot program and website "as is" without warranties of any kind
• We are not liable for indirect, incidental, special, or consequential damages
• Our total liability for direct damages is limited to the amount you have paid to StroomR (which is zero during the free pilot)
• We are not liable for damages resulting from power outages, internet disruptions, or third-party device malfunctions

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

7. Data and Privacy

Your use of our services is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal and energy data.

8. Termination

You may withdraw from the pilot program at any time by contacting us. We may also terminate your participation if:

• You breach these Terms
• The pilot program is discontinued
• Technical requirements are no longer met

Upon termination, we will disconnect the energy management system and delete your energy data within a reasonable period, unless retention is required by law.

9. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated to pilot participants via email. Continued use of our website or services after changes take effect constitutes acceptance of the revised Terms.

10. Governing Law

These Terms are governed by the laws of the Netherlands. Any disputes arising from these Terms or your use of our services shall be submitted to the competent court in the Netherlands.
